Terms of Service

These Terms of Service ("Terms") govern your use of the Ya Qalbi mobile app and the yaqalbiapp.com website (together, the "Service"), including the Ya Qalbi Premium subscription. The Service is operated by Chayland Design, LLC ("we", "us").

By installing the app, creating an account, subscribing, or using the website, you agree to these Terms and to our Privacy Policy, which also explains how the website uses Google Analytics and cookies. If you do not agree, do not use the Service.

1. The Service

Ya Qalbi is an educational app that teaches Lebanese Arabic through interactive lessons. The curriculum and exercises were authored with input from native Lebanese speakers. We make commercially reasonable efforts to keep translations and grammatical notes accurate, but language is alive and we don't guarantee that every entry reflects every regional or generational variation in Lebanese Arabic.

The course is free to use: every chapter, the audio on every word, and practice. An optional paid subscription, Ya Qalbi Premium, is described in section 6.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service you represent that you meet this age requirement. If you are between 13 and the age of majority in your jurisdiction, your parent or guardian must agree to these Terms on your behalf, and must give permission before you buy a subscription.

3. Your account

3.1 Using the app without an account

You may use the app without creating an account. In that mode, your progress is stored only on your device and is lost if you uninstall the app or reset it. A subscription bought without an account belongs to your Apple Account, not to your progress, and can be restored (section 6.8).

3.2 Signed-in use

If you create an account (with Apple, Google, or an email address and password), you are responsible for keeping your sign-in details secure. You may not share your account with another person. You agree to provide accurate information and to keep your email address current, because we use it for account emails such as password resets.

3.3 Username

The username you pick is displayed publicly on the leaderboard. You may not pick a username that impersonates another person, contains offensive language, or violates someone else's trademark. We reserve the right to rename or remove usernames that violate this rule.

3.4 Emails

If you have an account, we send account emails when they are needed (confirming your email address, resetting your password, confirming an email change, and confirming an account deletion). We may also send learning emails, such as a note after your first lesson, a reminder when your streak ends, and streak milestones; you can unsubscribe from those at any time. If you sign up for our emails on yaqalbiapp.com, we send the short series described there and occasional news, each with an unsubscribe link.

4. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract source code from the app
• Scrape, copy, redistribute, or republish the curriculum (vocabulary lists, lesson content, illustrations, audio, or characters) without our written permission
• Use automated tools, bugs, or other tricks to inflate your Nour, Nar (streak), Dahab, ta2a (energy), or leaderboard rank, or to get Premium features without a subscription
• Sell, transfer, or share access to your account or subscription
• Impersonate another person or misrepresent your affiliation with Ya Qalbi
• Submit abuse, harassment, or unlawful content through the in-app report-issue form
• Interfere with or disrupt the integrity or performance of the Service

5. Intellectual property

The Service, including all text, graphics, illustrations, characters (the phoenixes), curriculum content, audio, software, and the Ya Qalbi name and logo, is owned by Chayland Design, LLC and is protected by copyright, trademark, and other laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial language-learning purposes.

If you submit feedback or suggestions through the report-issue form or by email, you grant us a non-exclusive, royalty-free, worldwide license to use that feedback to improve the Service.

6. Ya Qalbi Premium (subscriptions)

6.1 What Premium includes

Everything in the course is free. Premium removes the ta2a (energy) limit described in section 7, so you can keep starting lessons however many you have failed. We may improve Premium over time. If we ever remove something material from Premium, we will tell subscribers in advance, and you can cancel before your next renewal.

6.2 Plans and prices

Premium is offered as a monthly or an annual subscription. In the United States the prices are $6.99 a month and $49.99 a year. In other countries the App Store sets the price in your local currency. The price, the billing period, and any free trial are shown on the Subscription screen before you confirm, and the price shown there at purchase is the price you pay for that period. Prices may include or exclude taxes depending on where you live.

6.3 Free trial

New subscribers may be offered a 7-day free trial. Apple decides who is eligible, generally one trial per Apple Account. If you do not cancel at least 24 hours before the trial ends, the subscription you chose begins and you are charged its price. Any unused part of a free trial ends when you buy a subscription.

6.4 Automatic renewal and billing

Payment is charged to your Apple Account when you confirm the purchase, or when your free trial ends. Your subscription renews automatically for the same period (a month or a year) unless you turn off automatic renewal at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within 24 hours before the end of the current period, at the then-current price.

6.5 Cancelling

You can cancel at any time in the app under Settings → Subscription → Manage subscription, or in your iPhone's Settings → your name → Subscriptions. Cancelling stops the next renewal. You keep Premium until the end of the period you have paid for. Deleting your Ya Qalbi account or the app does not cancel a subscription; only Apple can, so cancel it there first.

6.6 Refunds

Subscriptions are sold and billed by Apple, and we cannot issue refunds ourselves. To ask for a refund, use reportaproblem.apple.com; Apple's refund policy applies. Except where the law requires otherwise, payments are non-refundable and we do not give refunds or credits for partly used periods.

6.7 Price changes

We may change Premium prices. Apple will tell you before a price increase applies to your subscription, as its rules require, and where required will ask for your consent. If you don't want to pay the new price, cancel before it takes effect.

6.8 Restoring a purchase

Premium belongs to the Apple Account that bought it. On a new or reset device, sign in to the same Apple Account and tap Restore Purchase on the Subscription screen.

7. Ta2a (energy), Nour, Nar, and Dahab

The app uses a few in-app counters: Nour (points), Nar (your daily streak), Dahab (collected treasure), and ta2a (energy). Without Premium you have up to five ta2a. You lose one when you fail a lesson, never for starting or passing one, and you get them back over time, by practising, or by spending Dahab. How these counters work may change as we improve the app.

These counters are part of the game. They have no cash value, cannot be bought with money, sold, transferred to another person, or exchanged for anything outside the app, and are not property you own. We may correct balances affected by a bug, an error, or a breach of these Terms. Counters kept without an account are stored only on your device and are lost if the app is removed.

8. Termination

You may stop using the Service at any time. You may delete your account from inside the app (Profile → Settings → Edit Profile → Delete account) or by emailing us; see section 6.5 about cancelling a subscription first. We may suspend or terminate your account if you violate these Terms, after notice when practical. If we terminate your account for violating these Terms, you are not entitled to a refund of any subscription period, except where the law requires one.

9. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that every translation is the definitive or only correct one.

Some jurisdictions do not allow the exclusion of certain warranties; the above exclusions may not apply to you. Nothing in these Terms limits rights you have as a consumer that cannot be waived under the law where you live.

10. Limitation of liability

To the maximum extent permitted by law, in no event will Chayland Design, LLC, its members, or our contractors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total cumulative liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid for the Service in the 12 months preceding the claim, or (b) $100 USD.

11. Indemnification

You agree to indemnify and hold Chayland Design, LLC and its members harmless from any claim or demand, including reasonable attorneys' fees, made by a third party due to your breach of these Terms or your violation of any law or the rights of a third party.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Service will be brought in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

If you are a consumer in the EU or the UK, this clause does not affect the mandatory rights you have under local law, including the right to bring claims in the courts of your country of residence.

13. Apple App Store terms

If you downloaded the iOS app from the Apple App Store, the following also apply:

• Agreement. These Terms are between you and us, not between you and Apple. We, not Apple, are solely responsible for the app and its content.
• License. Your license to the app is limited to using it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may also be accessed by other accounts associated with you through Family Sharing or volume purchasing.
• Maintenance and support. We are responsible for providing maintenance and support for the app. Apple has no obligation to provide any maintenance or support.
• Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs, or expenses from a failure to conform to a warranty are our responsibility, to the extent these Terms don't disclaim them.
• Product claims. We, not Apple, are responsible for any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
• Intellectual property. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with any applicable third-party agreements when using the app, such as your mobile data plan.
• Contact. Questions, complaints, or claims about the app go to us at the address in section 15.
• Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, once you accept them, will have the right to enforce these Terms against you as a third-party beneficiary.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify signed-in users by email and update the "Last updated" date above. Continued use of the Service after a change means you accept the updated Terms. Changes to the price of a subscription follow section 6.7.
