Terms of Service

These Terms of Service ("Terms") govern your use of the Ya Qalbi mobile app and the yaqalbiapp.com website (together, the "Service"). The Service is operated by Chay Dib doing business as Chayland Design, a sole proprietorship in California, USA ("we", "us").

By installing the app or using the website, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Ya Qalbi is an educational app that teaches Lebanese Arabic through interactive lessons. The curriculum and exercises were authored with input from native Lebanese speakers. We make commercially reasonable efforts to keep translations and grammatical notes accurate, but language is alive and we don't guarantee that every entry reflects every regional or generational variation in Lebanese Arabic.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service you represent that you meet this age requirement. If you are between 13 and the age of majority in your jurisdiction, your parent or guardian must agree to these Terms on your behalf.

3. Your account

3.1 Anonymous use

You may use the app without creating an account. In that mode, your progress is stored only on your device and is not recoverable if you uninstall.

3.2 Signed-in use

If you create an account (via Apple, Google, or email), you are responsible for keeping your sign-in credentials secure. You may not share your account with another person. You agree to provide accurate information.

3.3 Username

The username you pick is displayed publicly on the leaderboard. You may not pick a username that impersonates another person, contains offensive language, or violates someone else's trademark. We reserve the right to rename or remove usernames that violate this rule.

4. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract source code from the app
• Scrape, copy, redistribute, or republish the curriculum (vocabulary lists, lesson content, illustrations, audio, or characters) without our written permission
• Use automated tools to inflate your XP, streak, or leaderboard rank
• Impersonate another person or misrepresent your affiliation with Ya Qalbi
• Submit abuse, harassment, or unlawful content through the in-app report-issue form
• Interfere with or disrupt the integrity or performance of the Service

5. Intellectual property

The Service, including all text, graphics, illustrations, characters (the phoenixes), curriculum content, software, and the Ya Qalbi name and logo, is owned by Chay Dib (Chayland Design) and is protected by copyright, trademark, and other laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial language-learning purposes.

If you submit feedback or suggestions through the report-issue form or by email, you grant us a non-exclusive, royalty-free, worldwide license to use that feedback to improve the Service.

6. Purchases (when applicable)

The Service is currently free to use. If we introduce paid features in the future, those purchases will be made through your platform's billing system (the App Store or Google Play), and that platform's refund and billing terms will apply alongside these Terms. We will update this section with specifics before any paid feature launches.

7. Termination

You may stop using the Service at any time. You may delete your account from inside the app (Profile → Settings → Sign out → Delete account) or by emailing us. We may suspend or terminate your account if you violate these Terms, after notice when practical.

8. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that every translation is the definitive or only correct one.

Some jurisdictions do not allow the exclusion of certain warranties; the above exclusions may not apply to you.

9. Limitation of liability

To the maximum extent permitted by law, in no event will Chayland Design, Chay Dib, or our contractors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total cumulative liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months preceding the claim, or (b) $100 USD.

10. Indemnification

You agree to indemnify and hold Chayland Design and Chay Dib harmless from any claim or demand, including reasonable attorneys' fees, made by a third party due to your breach of these Terms or your violation of any law or the rights of a third party.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Service will be brought in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

If you are an EU consumer, this clause does not affect the mandatory rights you have under EU law to bring claims in the courts of your country of residence.

12. Apple-specific terms

If you downloaded the iOS app from the Apple App Store, the following apply:

• These Terms are between you and us, not between you and Apple. We, not Apple, are responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
• You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify signed-in users by email and update the "Last updated" date above. Continued use of the Service after a change means you accept the updated Terms.
